SUPREME COURT DISMISSED KERALA’S PLEA TO LOWER LEVEL TO 120 FEET

In a major blow to Kerala, the Supreme Court on Tuesday, 13th December,2011, dismissed Kerala's plea to lower the water level of the Mullaperiyar dam to 120 feet from the present 136 feet. The court wanted the present water level to be maintained. The court also felt that the safety of people is important and it cannot be compromised. The court said that both Kerala and Tamil Nadu are adding fuel to fire on the Mullaperiyar dam issue. The constitution bench of the Supreme Court headed by Justice D K Jain took up the Mullaperiayar case on Tuesday. This bench had constituted an Empowered Committee to examine the safety of the dam and Kerala's request for constructing a new dam.

At the same time, the SC also flayed the TN stand on the issue. The SC came down heavily on the advertisements released by the TN govt in newspapers regarding the Mullaperiyar dam and said it was unnecessary. Observing that no emergency situation exists in Mullaperiyar which warrants such an action, the court said the high-level panel on Mullaperiyar would have taken an appropriate decision if this was the case. The court also criticised Tamil Nadu for publishing print advertisements with observations by court.
