LIVE IN RELATIONSHIP
The supreme courts observation that live in relationships and premarital sex are not an offense- is opposed to our ethos and moral values. What even the progress made by society value remain the same- while freedom should not be curbed. We should remember that we have a responsibility towards self and society. The court reportedly referred to Radha and Krishna while making an observation on live in relationships. Many stories in the Ramayana and the Mahabharata have philosophical and symbolic meanings, besides popular appeal. It would be naive to interpret them in modern legal and constitutional terms. Such observations could hurt the sentiments of many believers.
If living together can be justified on the basis of the puranes .Laws can be enacted by any government which has a two thirds majority in parliament. But custom is different. It has evolved over the years.
An act cannot be termed illegal is not necessarily legal. The judges should ask for the details of the newborn abandoned in hospitals and orphanages, most of whom are the products of pre- marital sex. Persons indulging in pre-marital sex may not be committing an offense but of it who bear the consequences for no fault of theirs. The comment on Lord Krishna and Radha were unnecessary.
The judges can only tell us what the law is. While every one has a right to his or her views on morality, no one has the right to impose them on others. Marriage, an institution that has evolved over the years, has its merits and demerits. If two adults decide to live together with out marriage,it would be cruel for a third person to interfere with freedom
The court cited Radha and Krishna to substantiate its observation. Krishna never had a live in relationship with Radha. There is no such mention in Srimad Bhagavatham or Vishnu Purana. Radha was a devotee of Krishna who spent his child hood in Brindvan. He left Brindavan when he was 16 to settle down in Dwaraka. He married Rukmini and Satyabhama and never returned to Brindavan.
