CHARGE SHEET FILED
The CBI on Friday 17th July 2009 filed charge sheets against two priests and a nun in the sister Abhaya death. The accused Fr Thomas Kottur, Fr Jose Puthrikayil and sister sephy had been charged with offence punishable under section 302 (murder)and section 201 ( causing disappearance of evidence) of Indian penal code. Two priests were also charged with offense punishable under section 499 (trespass) of the IPC.
The charge sheets said that Fr Thomas Kottur and Fr Jose Puthrikayal trespassed in to the pious x convent Hostel on the night of march 26, 1992, through the kitchen door of the hostel and remained in the cellar. Sister Sephy was already in the cellar. Both the accused were found in special circumstances’ when sister Abhaya, an inmate of the hostel, came down to the cellar to collect water from the refrigerator and the accused with a common intension to murder sister Abhaya in order to prevent her from telling what she had seen in cellar to others and in furtherance of the crime hit Abhaya with an axe ( Kodali) on the back of her head. She then collapsed. Then the first and second accused, assisted by the third accused, lifted sister Abhaya who was un conscious, through the kitchen door and dumped her in a well behind the building to make it appear that the she had committed suicide,\. The charge sheet cited as many as 133 persons as witnesses and 70 documents were submitted before the court.
