Pinaray Vijayan in the Lavaline Case.


The central Bureau of Investigation on Thursday 11th June 2009 field charge sheet against nine accused, including former power Minister Pinarayi Vijayan. In the SNC Lavalin case of before the CBI special court in Kochi , after Governor R.S Gavai according sanction for the prosecution of Communist Party of India (Marxist) state secretary Pinarayi Vijayan and the other accused are charged with offences under sections 120B (criminal Cons piracy) and 420 (cheating) of the Indian penal code ( IPC) and the provisions of the prevention of corruption act. Mr Vijayan is the 7th accused in the case.
The case related to alleged irregularities in the award of the renovation and modernization work of the Pallivassal, sengulam and Panniyar hydroelectric projects to SNS Lavalin. The CBI charge sheets alleged that the contract awarded at a higher rate violating in the relevant rules and regulations and procedures.
The chare sheets said that Pinarayi Vijayan while serving as Minister for Electricity from may 1996 to October 1998 along with then principlal secretary, power, Sri K. Mohana chandran and then Kerala state electricity board chairman P Sivadasan, had hatched a criminal conspiracy to award the sup play contract for the renovation and modernization work to SNC Lavalin
The CBI pointed out that accused had failed to get a binding agreement executed by the company for ensuring the promised grant for the proposed cancer centre. Thus the accused had allowed the company to cheat the government of Rs 86.25 crores
The CBI alleged that the norm on getting the concurrence of the central electricity authority for a project over Rs 100 corer had also being bypassed. The Accused had obtained the cabinet’s approval for the project fraudulently by suppressing this aspects.
The CPI State secretariat is meeting on Friday 12 th June 2009 almost specifically to discuss the the situation arising from the governors decision and the stand that the party should adopt when the issue figures in cabinet
The leader of the opposition Ommenchandi on Thursday 12 -th June 2009 said Home Minister Kodiyeri Balakrishnan had no moral right to continue in office as he had criticized the Governor and the chief Minister who occupied constitutional posts
