the International Court of Justice (ICJ) at The Hague on16th May,2017, Tuesday
acted on India’s petition and, in effect, asked Pakistan to stay the execution
ordered by a Pakistan military court. Jadhav, a retired Indian Navy officer,
was arrested by Pakistan and found guilty of being a spy for India’s intelligence
agencies. He was awarded the death sentence in April.In his letter to the Pakistan
government, President of the ICJ Ronny Abraham said: “In my capacity as
President of the court, and exercising the powers conferred upon me under
Article 74, paragraph 4 of the Rules of Court, I call upon your excellency’s
government, pending the court’s decision on the request for the indication of
provisional measures, to act in such a way as will enable any order the Court
may make on this request to have had its appropriate effects.”
The ICJ was acting on a
petition moved by India on Monday,where it accused Pakistan of “egregious
violations of the Vienna Convention on Consular Relations”. In its application,
India had said it was not informed of Jadhav’s detention until long after his
arrest and that Pakistan failed to inform the accused of his rights.
India further argued that
Pakistan was in violation of the Vienna Convention, as its authorities were
denying India the right of consular access to Jadhav, despite repeated
requests. Moreover, India said it learnt about Jadhav’s death sentence from a
press release. India also said it had information that Kulbhushan Jadhav was
kidnapped from Iran, where he was carrying on business after retiring from the
Indian Navy, and was then shown to have been arrested in Baluchistan on March
3, 2016, and that they were notified of that arrest on March 25, 2016. India
also said it sought consular access to Kulbhushan Jadhav on March 26, 2016 and
repeatedly thereafter for at least 16 times.

ചൂണ്ടിക്കാട്ടി.
ഇന്ത്യയുടെയും പാകിസ്താന്റെയും വാദങ്ങള്‍ കോടതി കഴിഞ്ഞദിവസം കേട്ടിരുന്നു. ഇന്ത്യന്‍ നാവികസേനയിലെ മുന്‍ ഉദ്യോഗസ്ഥനായ ജാദവ് ഇന്ത്യയ്ക്ക് വേണ്ടി ചാരവൃത്തി നടത്തിയെന്ന കുറ്റം ആരോപിച്ചു കഴിഞ്ഞ മാസമാണ് പാക് കോടതി വധശിക്ഷ വിധിച്ചത്. വധശിക്ഷ രാജ്യാന്തര കോടതി തല്‍ക്കാലത്തേക്ക് മരവിപ്പിച്ചിരുന്നു.ബിസിനസ് ആവശ്യത്തിന് ഇറാനിലെത്തിയ ജാദവിനെ പാകിസ്താന് ബലൂചിസ്താനിലേക്ക് തട്ടിക്കൊണ്ടുവന്നതാണെന്നും ആരോപണങ്ങള്‍ കെട്ടിച്ചമച്ചതാണെന്നും ആണ് ഇന്ത്യയുടെ നിലപാട്. ശിക്ഷ വിയന്ന കണ്‍വെന്‍ഷന്‍ വ്യവസ്ഥകളുടെ ലംഘനമാണെന്ന് തിങ്കളാഴ്ച അന്താരാഷ്ട്രക്കോടതിയില്‍ ഇന്ത്യക്ക് വേണ്ടി ഹാജരായ പ്രമുഖ അഭിഭാഷകന്‍ ഹരീഷ് സാല്‍വെ വാദിച്ചിരുന്നു. വിചാരണ സ്വതന്ത്രമായിരുന്നില്ലെന്നും നിയമസഹായം എത്തിക്കാന്‍ ഇന്ത്യയെ അനുവദിച്ചില്ലെന്നും അദ്ദേഹം ചൂണ്ടിക്കാട്ടി. 16 തവണ ഈയാവശ്യം ഉന്നയിച്ച് ഇന്ത്യ പാകിസ്താന് കത്ത് നല്‍കിയിരുന്നു.
കുല്‍ഭൂഷണ്‍ ജാദവ് ഇന്ത്യയുടെ ചാരനാണെന്നും അദ്ദേഹത്തിന് വിയന്ന കണ്‍വെന്‍ഷന്റെ പരിരക്ഷ ലഭിക്കില്ലെന്നുമായിരുന്നു പാകിസ്താന്റെ പ്രധാനവാദം. ജാദവിന്റെ കുറ്റസമ്മതമൊഴിയാണ് അവര്‍ പ്രധാന തെളിവായി ചൂണ്ടിക്കാട്ടിയത്. എന്നാല്‍, ഇതിന്റെ വീഡിയോ കാണാന്‍ അന്താരാഷ്ട്ര കോടതി വിസമ്മതിച്ചത് വാദത്തിനിടയില്‍ പാകിസ്താന് തിരിച്ചടിയായിരുന്നു.മഹാരാഷ്ട്രയിലെ സാംഗഌ സ്വദേശിയാണ് 47 കാരനായ കുല്‍ഭൂഷണ്‍ ജാധവ്. അച്ഛന്‍ മുംബൈയില്‍ പൊലീസ് ഉദ്യോഗസ്ഥനായിരുന്നു. ഭാര്യയും രണ്ട് കുട്ടികളുമുണ്ട്. മുംബൈയിലെ പൊവായിലാണ് കുടുംബം ഇപ്പോള്‍ താമസം. നാവികസേനയില്‍ നിന്ന് വിരമിച്ച ശേഷം ബിസിനസുകാരനായി. 2016ലാണ് ഇറാന്‍-പാകിസ്താന് അതിര്‍ത്തിയില്‍വെച്ച് പാകിസ്താന് രഹസ്യാന്വേഷകര്‍ അദ്ദേഹത്തെ പിടികൂടിയത്. റോ ഏജന്റാണ് ജാദവ് എന്നാണ് പാകിസ്താന് ആരോപിക്കുന്നത്.
